Category Menu - Max Depth Validation Bug

Currently using CMSB version 3.05

Test Scenario:

Max Depth set to 3

Parent Category 1 (Level 1)
   - Child Category 1 (Level 2)
      - Child (Level 3)
      - Child (Level 3)
      - Child (Level 3)

Parent Category 2 (Level 1)
   - Child Category 2 (Level 2)
      - Child (Level 3)
      - Child (Level 3)
      - Child (Level 3)

In this scenario, the Parent Category Select Menu will allow us to place "Child Category 1" as a Child (Level 3) of "Child Category 2"... Being that "Child Category 1" had Level 3 Children, after this move those Level 3 Children become Level 4 Children - exceeding the Max Depth value.
